VA Effective Dates and Back Pay: How VA Picks the Date—and How to Challenge the Wrong One
Why the effective date matters
Even when VA eventually grants service connection or increases a rating, the effective date determines how far back VA pays you.
A difference of even a few months can be meaningful. A difference of years can be life-changing.
The general rule: “Date of claim” vs “date entitlement arose”
The VA regulation that governs many effective-date issues states (in substance):
Except as otherwise provided, the effective date is the date VA received the claim or the date entitlement arose, whichever is later.
That “whichever is later” language is the source of many disputes—especially when VA treats a later exam date as the first proof of severity even though earlier evidence exists.
The big exception: filing within 1 year of separation
For direct service connection, the regulation provides that if VA receives the claim within 1 year after separation, the effective date can be the day following separation (or the date entitlement arose, if later).
This is one reason we strongly encourage recently separated veterans to file promptly—even if they’re still gathering records.
How back pay is typically triggered
Back pay is usually the difference between:
what VA should have paid from the effective date forward (based on the final grant/rating), and
what VA actually paid during that period.
Common effective date problems we see in practice

VA assigns the date of a later filing even though an earlier claim/appeal path may still be in play
VA focuses on the date of a C&P exam instead of earlier evidence showing severity
VA overlooks evidence that supports an earlier “entitlement arose” date
Veterans miss the one-year decision review deadline, forcing a more limited path

When you get a VA decision, review:
The “effective date” line for each condition
The evidence VA lists (did they ignore earlier records?)
The narrative explanation (why did they pick that date?)
Your filing timeline (when did you file; did you file within 1 year of separation?)
